Dentro de estos podemos destacar la Ley 2306 de 2023,&nbsp;&nbsp; sancionada el&nbsp; 31 de Julio,&nbsp;&nbsp; la cual estableci\u00f3 un precedente para la protecci\u00f3n de las madres y su situaci\u00f3n laboral frente al tiempo de lactancia, y los cuidados&nbsp;&nbsp;&nbsp; que necesitan los ni\u00f1os en sus primeros meses de vida. &nbsp;<\/p>\n<p><\/p>\n<p><\/p>\n<p>Lo anterior, trajo consigo una&nbsp; gran cantidad de&nbsp; interrogantes en las compa\u00f1\u00edas, ya que a\u00fan se &nbsp;evidencian las consecuencias a nivel econ\u00f3mico&nbsp; ocasionadas&nbsp; por la crisis sanitaria que se atraves\u00f3 desde el a\u00f1o 2020, y esto para las organizaciones, es una nueva variable a considerar dentro del plan estrat\u00e9gico.<\/p>\n<p><\/p>\n<p><\/p>\n<p>En lo que respecta &nbsp;al sector empresarial, empieza un periplo de esfuerzos financieros, para darle cumplimiento a la reci\u00e9n sancionada Ley,&nbsp; y poder realizar &nbsp;cambios en sus instalaciones, reformas en pol\u00edticas internas y reestructuraci\u00f3n de jornadas, con el fin de poder satisfacer las eventuales necesidades del cargo de la madre.<\/p>\n<p><\/p>\n<p><\/p>\n<p>Ahora bien &nbsp;la Ley 1823 de 2017, &nbsp;ya contemplaba en su literalidad, disposiciones para las empresas privadas en lo concerniente a beneficios para la madre lactante, sin embargo, limitaba su alcance, a aquellas que su capital fuera igual o superior a 1.500 SMLMV, o que tuvieran m\u00e1s de 50 trabajadoras; sustancialmente contrario a lo dispuesto por la &nbsp;Ley 2306,&nbsp; que &nbsp;deja un vac\u00edo exponencial, &nbsp;en virtud que no precept\u00faa requisitos o condiciones para estar obligado a la &nbsp;creaci\u00f3n de &nbsp;las salas de lactancia; por tanto todas las empresas estar\u00edan obligadas, lo cual es un factor a tener presente, dado que a\u00fan no se vislumbra &nbsp;reglamentaci\u00f3n por parte del Ministerio de Salud que permita llenar los vac\u00edos y aclarar las dudas.<\/p>\n<p><\/p>\n<p><\/p>\n<p>De la misma forma con esta Ley, se exige inicialmente al empleador, concederle durante los primeros seis meses de edad del ni\u00f1o, a la madre lactante, dos espacios de treinta minutos cada uno dentro de la jornada laboral, permiti\u00e9ndole alimentar al menor.
