{"id":1289,"date":"2023-05-24T17:44:32","date_gmt":"2023-05-24T22:44:32","guid":{"rendered":"https:\/\/gonzalezlawyersgroup.com\/?p=1289"},"modified":"2023-05-24T17:44:34","modified_gmt":"2023-05-24T22:44:34","slug":"reforma-laboral-vs-mipymes","status":"publish","type":"post","link":"https:\/\/gonzalezlawyersgroup.com\/en\/reforma-laboral-vs-mipymes\/","title":{"rendered":"Reforma Laboral Vs MiPymes"},"content":{"rendered":"<p class=\"has-text-align-left\">La reforma laboral que actualmente se encuentra radicada ante el Congreso de la Rep\u00fablica, mantiene en vilo, a los diferentes sectores del pa\u00eds, los cuales directa o indirectamente, se sienten amenazados por su contenido. Hay que tener en cuenta, que son muchos los actores involucrados en esta, cuyo&nbsp; eje principal, es la formalizaci\u00f3n del empleo,&nbsp; bajo los principios de justicia y dignidad de los trabajadores.<\/p>\n\n\n\n<p>Partiendo del entendido, que una reforma es equivalente a cambios, y que los cambios traen consigo consecuencias, es importante atender el impacto en cada uno de los gremios afectados; tal como sucede con las Micro, peque\u00f1as y medianas empresas \u2013Mipymes- que con m\u00e1s del 96%, representan el mayor segmento empresarial del pa\u00eds, generando cerca del 81% de los empleos a nivel nacional, por lo que cualquier modificaci\u00f3n que promueva este proyecto de Ley, concentra la atenci\u00f3n de este importante sector.<\/p>\n\n\n\n<p>Por lo anterior, en diferentes oportunidades, voceros de esta agremiaci\u00f3n, han clamado porque la reforma laboral se haga bajo dos lineamientos: Jur\u00eddico y Econ\u00f3mico, dado que para esta colectividad, no se puede promover una Ley como esta, desatendiendo las implicaciones econ\u00f3micas que esto conlleva, enfatizando as\u00ed,&nbsp; la incidencia en la generaci\u00f3n de empleos y en la diferenciaci\u00f3n que se debe hacer entre los empleadores de este gremio y las grandes empresas respecto a los costos laborales.<\/p>\n\n\n\n<p>Aunado a lo anterior, recordemos que para un empleador, contratar a un trabajador, representa en costo laboral, una cifra superior al salario m\u00ednimo, pues a esto, se debe incluir los aportes a la seguridad social, el pago de prestaciones sociales y los parafiscales, cifra que para en el a\u00f1o 2023 se estima en $1.770.406 pesos mensuales, y&nbsp; que de aprobarse el proyecto de la reforma, se prev\u00e9 aumente en un 40%, situaci\u00f3n que desmejora las condiciones del gremio de las Mipymes, ya que la generaci\u00f3n de empleo y el fortalecimiento empresarial se convertir\u00e1 en un desaf\u00edo mayor.<\/p>\n\n\n\n<p>En cuanto a los costos laborales, es necesario hacer un paralelo entre las grandes empresas las cuales representan cerca del 0,5 % del tejido empresarial, cuyo adjetivo de \u201cgrandes\u201d se refiere a sus ingresos superiores a los $60.000 millones de pesos, en el sector de la manufactura; $75.000 millones, en el de comercio, y $17.000 millones en el de servicios, y las Mipymes cuyas cifras de sus ingresos no se acercan a los anteriores, y por tanto, resulta injusto e inequitativo que un peque\u00f1o empresario asuma las mismas responsabilidades econ\u00f3micas que un gran empresario, en calidad de empleadores.<\/p>\n\n\n\n<p>As\u00ed las cosas, los representantes de las Mipymes, consideran que el documento que pretende redefinir aspectos como recargos nocturnos, dominicales, contratos laborales, y tercerizaci\u00f3n laboral, entre otros, traer\u00e1 consigo repercusiones negativas, evidenciadas en el&nbsp; fracaso de empresas consolidadas y la reducci\u00f3n de las iniciativas empresariales, toda vez que, ser\u00e1n mayores los costos que un empleador deber\u00e1 asumir respecto de sus trabajadores, e incluso, ante una eventual&nbsp; desvinculaci\u00f3n, ya que la propuesta de que el contrato a t\u00e9rmino indefinido sea la regla general, limitar\u00eda las causales de terminaci\u00f3n contractual a un despido por justa causa.<\/p>\n\n\n\n<p>Igualmente, resaltan que la tendencia actual de las relaciones laborales, no es capricho de los empresarios, por el contrario, es producto de una sociedad que se ha venido reinventando desde tiempos anteriores a la pandemia ocasionada por el Covid-19, y que ha encontrado en las herramientas tecnol\u00f3gicas tales como las aplicaciones de delivery, una importante fuente de ingresos.<\/p>\n\n\n\n<p>Finalmente, aunque el futuro sobre este asunto a\u00fan es incierto, hay algo que si es claro, uno de los objetivos fundamentales&nbsp; del Estado, debe ser la generaci\u00f3n de empleos, y en virtud de que estos actualmente en el pa\u00eds, son proporcionados en su mayor\u00eda, por las Mipymes, se debe lograr obtener un consenso que permita beneficios y la menor afectaci\u00f3n para las partes, ya que el empleo&nbsp; igualmente&nbsp; posee un prop\u00f3sito de justicia y dignidad respecto a los trabajadores.<\/p>\n\n\n\n<p>En este orden de ideas, debe existir una diferenciaci\u00f3n entre las categor\u00edas empresariales, que logre disminuir las cargas previstas con la reforma laboral a las Mipymes, as\u00ed como tambi\u00e9n, la adopci\u00f3n de propuestas, tales como la gradualidad en la implementaci\u00f3n de la jornada diurna y nocturna, y la implementaci\u00f3n de modelos flexibles, con el fin de reducir los aspectos negativos que se presumen con este Proyecto de Ley.<\/p>","protected":false},"excerpt":{"rendered":"<p>La reforma laboral que actualmente se encuentra radicada ante el Congreso de la Rep\u00fablica, mantiene en vilo, a los diferentes sectores del pa\u00eds, los cuales directa o indirectamente, se sienten amenazados por su contenido.
